A Manhattan assemblyman faces charges of driving while intoxicated in an Albany suburb.
Assemblyman Robert Rodriguez was pulled over early Tuesday morning in Colonie, New York after police say his Jeep Grand Cherokee swerved out of its lane.
Police say he failed a field sobriety test and refused to take a breathalyzer test.
He's set to appear in court upstate Monday.
Rodriguez's spokeswoman said he was returning to a motel after watching basketball with friends at a bar.
