The man accused of raping a 21-year-old college student in Manhattan was given a delayed sentencing for other charges just days earlier.
According to the Daily News, Manhattan Supreme Court Judge Michael Sonberg postponed Lawrence Elliot's sentencing on drug charges for a month so he could take care of his ailing father.
Elliot was arrested on Saturday and charged with raping and robbing a City College student in her Hamilton Heights apartment last Thursday.
The prosecutor in Elliot's drug case had objected to the judge's decision to let him walk free temporarily.
Elliot has a long rap sheet, which includes six years in jail for a rape conviction in 1993.
He was to be sentenced for leading an undercover police officer to a cocaine dealer last year.
A spokesman for the State Office of Court Administration said the judge is regretful of what happened.
