Greg Kelly will soon be back on the air.
The "Good Day New York" anchor will return to work on Friday.
The decision comes as officials say he will not face rape charges.
In a letter to Kelly's lawyer, the Manhattan district attorney's office said the facts in the case do not constitute a crime under state law.
A woman accused Kelly of rape three months after the two had gone out.
Because Kelly is the son of Police Commissioner Ray Kelly, police handed the investigation over to the D.A.'s office to avoid a conflict of interest.
Prosecutors say they interviewed Kelly and his accuser, consulted witnesses and reviewed receipts, text messages and phone records.
