Jurors Find Defendant Guilty In Manhattan Parking Spot Assault Trial

A man was found guilty Tuesday of punching a woman over an East Village parking spot, but he was acquitted of the more serious felony assault charge.

Oscar Fuller, 35, was convicted of assault in the third degree in his retrial.

Jurors found him guilty of punching Lana Rosas in February 2011 as they fought over a space in the East Village.

Fuller's lawyer, Thomas Kenniff, considered the outcome a minor victory.

"We didn't deny that Oscar threw the punch, we didn't deny that as a result of that punch Ms. Rosas fell back and tragically impacted her head on the concrete. What we said since day one was that Oscar never intended for anything like that to occur or saw that that was going to occur," Kenniff said.

Prosecutors said Fuller hit Rosas so hard, she flew backwards and hit her head, suffering a serious brain injury.

Fuller's attorneys claimed self-defense.

His sentencing is scheduled for June 18.
